These Terms and Conditions (“Terms”) govern your use of the nomnomnom website and app. By creating an account or using the service, you agree to these Terms. Please read them carefully.
nomnomnom is a food delivery marketplace that connects customers with local restaurants in Orange County, California. We facilitate ordering and coordinate delivery; the food is prepared by the restaurants and delivered by third-party couriers.
You must be 18 years of age or older, or the age of majority in your jurisdiction, to use nomnomnom.
Creating an account requires phone number verification. You may hold one account per person, and you are responsible for maintaining the security of your account and for all activity that occurs under it.
By creating an account, you consent to receive SMS messages for verification purposes.
You can opt out at any time by replying STOP to any message.

Message frequency varies — messages are sent only when you request a verification code.
All prices are shown in U.S. dollars (USD) and are final at checkout. Payments are processed securely via Stripe. Placing an order constitutes an offer to purchase, which is accepted when the restaurant confirms.
Deliveries are fulfilled by third-party couriers (Uber Direct). Delivery times shown in the app are estimates and may vary based on restaurant preparation time, courier availability, traffic, and weather.
You may cancel an order within the cancellation window shown in the app, which generally applies before the restaurant begins preparing your food. Once preparation has started, an order may no longer be cancellable. Refund eligibility depends on the status of the order and the nature of the issue (for example, missing or incorrect items). To request a cancellation or refund, contact support@getnomnomnom.com.
nomnomnom+ is an optional paid subscription billed on a recurring monthly or annual basis, depending on the plan you choose. It renews automatically until cancelled. You may cancel at any time, and cancellation takes effect at the end of your current billing period. Fees already paid are non-refundable except where required by law.
You agree not to engage in fraud, abuse, or any misuse of the platform, including submitting false orders, attempting to circumvent fees, harassing restaurants or couriers, or interfering with the operation of the service.
To the fullest extent permitted by law, nomnomnom and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim relating to the service shall not exceed the amount you paid for the order giving rise to the claim.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
